Prestige Imports Releases Reminder on New Colorado Cell Phone Law

Denver, Colorado, November 17, 2009 - Prestige Imports Collision Repair Center today released a public service announcement to remind area drivers of the new Colorado legislation concerning use of cell phones. Numerous studies confirm the potential distraction and driving hazard that cell phone use can present. The new legislation aims to improve highway safety by reducing the potential for distraction.
The new Colorado legislation is known as house bill 1094. It prohibits operators of a motor vehicle who are under 18 years of age, operators of a school bus, and motor vehicle carriers regulated by the public utilities commission from using a wireless telephone while a motor vehicle they’re operating is in motion. The new law does permit the operators of a motor vehicle who are 18 years of age or older to use a wireless telephone with a hands free system. Numerous commercial hand free product offerings are available for drivers with cars that are not already equipped.
Violation of the new cell phone driving law will be considered a secondary offense. A secondary offense means that the driver using a cell phone or mobile communication device must first be violating a primary enforcement law such as reckless driving, speeding or running a red light before they can be ticketed for violating Colorado's cell phone law. The new law takes effect on December 1st, 2009. Fines are established as $50 plus a $6 surcharge for a first offense and $100 plus a $6 surcharge for a second offense.
Some drivers are prohibited from using any kind of mobile communication device while driving. Drivers subject to this restriction includes those using any type of instruction permit. This includes text messaging and does not allow for hands free operation of a cell phone. Regardless of age, if you are driving with any kind of learner or instruction permit this restriction applies.
